Derby City Council v BA and others (Secretary of State for Education and another intervening) and other cases [2021] EWHC 2931 (Fam) MacDonald J

Interests:

Natalie was the Solicitor for a child/young person in inherent jurisdiction proceedings. Natalie’s client was represented by Queen’s Counsel (now King’s Counsel) barrister in proceedings in the High Court Family Division in a group case involving a number of other cases. The issue concerned Deprivation of Children in unregistered placements and the role of the Practice Guidance issued by the President of the Family Division: Placements in unregistered children’s homes in England or unregistered care home services in Wales (the Practical Guidance), in the use of the inherent jurisdiction of the court for unregistered placements. Our client’s Counsel successfully argued on her behalf that the new guidance did not conflict with the court’s use of the Inherent Jurisdiction to authorise a deprivation of liberty pending registration and the coming into force of regulations, but subject to regular review by the courts.
